Standard terms and conditions of contract
All enquiries, advice, quotations or estimates provided by or reservations made and/or all services rendered by or on behalf of Signature Travel Pty Ltd (‘Signature Travel’) are subject to these terms and conditions (‘the Conditions’).
THE CLIENT AND AUTHORITY
It is expressly confirmed that the person making the enquiries has read, understood and accepted the Conditions and to have the authority to do so on behalf of the person in whose name the enquiry/ reservation has been made and/or has the consent of the person to whom the services are rendered (collectively referred to as ‘the Client’)
Reservations will only be processed once we have received a reservation form and a signed copy of our Terms and Conditions from you. Nevertheless, even if we do not receive a signed copy back you will be deemed to have read, accepted and clarified any misunderstandings and agree to be bound by these Terms and Conditions, upon payment of a requested enquiry.
PRICES AND PAYMENT
Prices are correct at time of estimation/ invoicing and are based on current airfares, taxes, hotel rates
and the current rate of exchange as advised by commercial banks on the day. Prices are subject to change until full payment is received by Signature Travel. Final prices are only calculated on the day that we receive final payment. Once you have paid in full there will be no change and the price paid is guaranteed.
Signature Travel reserves the right, without prior notification, to adjust prices in accordance with increases in airfares, air fuel taxes, government and/or airport taxes and in the event of any currency and/or price adjustments, which may
become effective up to the date full payment is received by Signature Travel. item(s) as these amounts are levied by third parties, and therefore beyond our control.
Full payment of the reservation is required within 24 hours to avoid currency devaluation which could negatively impact the total package price or as per the outline of payment required as advised by the consultant liaising with your request. All prices are quoted in SA Rand and are subject to currency fluctuations. As our 3rd party suppliers may provide pricing in Foreign currency ( USD, EUR, GBP etc) ,All reservations not paid within the 24 hour period will be re-costed and any differences will be borne by the customer.
The actual SA Rand price will be valid for the period stated in the estimation/quotation e.g. 24 hours, provided full payment is received by the date stated. Please check with our consultant regarding the final amount reflected and requiring payment prior to making the payment.
We have the right to cancel your reservation if we do not receive your total fare by the relevant due date. If this happens, the cancellation clause below will apply and any deposit we have received will be applied against the new amount due.
Booking request only become firm reservations when our office confirms that we have received your deposit/ payment.
In the case of air tickets, full payment is required as per the applicable fare rule. If full payment is not received by the applicable date the airline will automatically cancel the reservations.
Exclusions
Prices do not include airport or tourist taxes, costs of getting passports, visas, telephone calls, laundry, entertainment arrangements, lunches and drinks, or any other costs you may incur (unless these have been specified in your itinerary),as well as personal items.
NOTE: Foreign credit cards, Amex credit cards and Diners credit cards will not be accepted.
RESPONSIBILITY
Signature Travel and their associated companies and agents, act as an intermediary only in producing and reserving various travel arrangements, and on condition that they will not be liable for any injury, damage, loss, accident, delay or any other irregularity that may be occasioned by any defect in any vehicle, or other form of conveyance, or by error or default of any company or person engaged in conveying the passenger, carrying out the arrangement of the tour or otherwise in connection therewith. The passenger tickets in use by the airline or charter when issued shall constitute the sole contract between the airlines or charter and the purchasers of those tickets and/or passenger. Signature Travel makes every effort to ensure that all arrangements and services connected with your travel arrangements will be carried out as specified in the most efficient and effective way possible. However, being intermediaries, we do not have direct control over the provision of services by suppliers and, whilst they are in all cases selected with the utmost care, we do not accept liability for error and omissions of such suppliers. It is the clients’ responsibility to satisfy themselves with any local laws and applicable insurance options, if any, for any facilities used or hired.
The condition for this is that we not be held liable for any injury, damage, loss, accident, delay or other irregularity that may happen due to ground operators’ defect/s, other than liability in terms of section 61 (1) of the Consumer Protection Act (CPA). This may occur in any vehicle or other form of carriage or by error by any company or person engaged in conveying a passenger, while carrying out a tour or participating in any activity.
INSURANCE
It is strongly advised that all clients take out adequate insurance cover such as cancellation due to illness, worldwide epidemics such as SARS, Coronavirus, etc, accident or injury, personal accident and personal liability, loss of or damage to baggage and sports equipment. Signature Travel will not be responsible or liable if the client fails to take adequate insurance cover. Should the insurers dispute their liability for any reason; the client will have recourse against the insurers only.
Please note that various credit card companies offer limited levels of travel insurance, which Signature Travel does not consider sufficient cover for international travel. Kindly check with the respective credit card companies in order to obtain the specific details of the cover.
TRAVEL DOCUMENTS
Documents (vouchers, itineraries etc) are only prepared and released after full payment has been received
All onward travel arrangements (local and international & on return to RSA, domestic connecting flights) must be reconfirmed by the Client 72 hours prior to departure.
AIR TICKETS
Cancellation fees apply once air tickets are issued. The cancellation fees range between 25% up to 100% (plus VAT) of the total airfare paid, dependent on the class of travel and the airline concerned. Depending on the rules related to the airfare, Once issued, certain tickets cannot be changed and are non-refundable. Airlines are non-negotiable to changes post ticket issuance. Passengers are reminded that they are responsible for reconfirmation of flights and flight times at least 72 hours prior to departure to ensure the airline has had no schedule or time changes. Failure to reconfirm flights with the airline concerned could lead to the cancellation of the flight reservation. Also note that if your flight/itinerary consists of more than one flight/coupon/ticket, you are not allowed to use such tickets/coupons out of sequence or to ‘skip’ one (& e.g. opt for train, bus or car transport) as this will VOID the entire balance of the journey/itinerary. ‘No-shows’ may result in the ticket being voided and/or the Client being charged a cancellation fee Note that the Air Terms and Conditions shall constitute the sole contract between the airline and the Client and any right of recourse the Client may have, will be solely against the airline in terms of the Air Terms and Conditions Please contact your consultant regarding refunds for unused tickets as strict rules apply Signature Travel is not responsible for the over reservation by airlines resulting in passengers being denied boarding. Providing passengers adhere to check in time, it is the airlines responsibility to reroute or rebook flights.
LATE RESERVATION & AMENDMENT FEES
A late reservation fee will be charged for requests received within 10 days of departure. Once confirmed these reservations will carry cancellation fees. Due to the policies of our suppliers we require full payment before we can request availability for reservations made. If the requested service/s is unavailable, we will refund the full amount. An amendment fee of R300 will be charged for each amendment made to a fully confirmed reservation. This amendment fee excludes the applicable airline reissue/cancellation fee (applicable if tickets have already been issued) as well as the applicable land cancellation fees. Amendments will only be processed upon receiving a written request to process from an authorised person.
CANCELLATION
Suppliers reserves the right to cancel any portion of the reservation before departure, in which event the entire payment for that service will be refunded to the Client without any further obligation on the part of Signature Travel. In the event of the Client cancelling, Suppliers may charge cancellation fees over and above those stated below
Where the reservation includes a special fare, the airline levies the relevant charges. In some circumstances this may be 100% of the total fare, regardless of when cancellation is affected.
Where the reservation is for a package, the Client will be responsible for all cancellation charges relating to the various components, of whatsoever nature, imposed by the suppliers providing the component parts of such travel arrangements. Signature Travel charges a cancellation fee equal to 10% of the package price on any finalised reservation. This would be in addition to any charges raised by the suppliers. However, Signature Travel reserves the right to charge an appropriate cancellation fee in its sole discretion and depending on the circumstances. Any monies, which you have already paid will be taken as payment or part payment of any cancellation charges.
As Signature Travel acts as an intermediary no refunds will be considered in any circumstances whatsoever by Signature Travel. Refunds are issued by the suppliers providing the service and will be subject to their terms and conditions
UNUSED SERVICES
No refunds will be paid for unused services, whether or not these are part of the basic package, and whether or not they are pre-booked optional arrangements. No refunds can be considered on partially unused hotel accommodation, flights or car rentals.
UNSCHEDULED EXTENSIONS AND ITINERARY VARIATIONS
In the unlikely event of there being an unscheduled extension or Itinerary variation to your travel arrangements caused by flight delays, bad weather, strikes, or any other cause which is beyond the control of Signature Travel, it is understood that the expenses relating to these unscheduled extensions, (hotel accommodation, airline costs, car hire, transfers, etc.), will be for your account. Signature Travel accepts no liability for changes, omissions, or delays before or during the course of your travel arrangements occasioned by technical difficulties, weather conditions, strikes, epidemics or communication breakdowns or the like.
PASSPORTS, VISAS & HEALTH
It is the Client’s responsibility to ensure that all passports and visas are valid. Passports are required to be valid for six months after return to home country. Passports require atleast 3 blank pages available for entry stamps.
Please ensure that vaccinations (e.g Yellow fever), inoculations, prophylactic (e.g. for malaria) where required, have been obtained. Signature Travel will endeavour to assist the Client with relevant information but such assistance will be at Signature Travel’s discretion and the Client acknowledges that in doing so, Signature Travel is not assuming any obligation or liability and the Client indemnifies Signature Travel against any consequences of non-compliance. We strongly recommend that the necessary precautions be taken in this regard and recommend that you check with your medical practitioner before departure.
SPECIAL REQUESTS
Should you have any special requests these should be conveyed to us at the time of reservation. Signature Travel will endeavour to comply with special requests however Signature Travel cannot guarantee that these special requests will be met.
MEDICAL PROBLEMS
If you or any member of your party has any medical problem or disability which may affect your holiday, you need to give us full details in writing at the time of booking. If we reasonably feel unable to properly accommodate the particular needs of the person concerned, we reserve the right to decline their reservation. We reserve the right to cancel the reservation should we become aware of any such medical problem or disability which has not been disclosed.
HOTEL CHECK-IN/CHECK-OUT
Check-in is usually after 3pm (this may be delayed during peak season) and check-out is usually before 10am. To avoid inconvenience, please confirm these times with the specific hotel. Should arrival and departure be required before or after these times additional fees may be incurred and will be the responsibility of the Client.
RENOVATIONS
Hotels undergo renovations from time to time and take all possible steps to limit disruption to their guests. We will not entertain complaints or requests for refunds if a hotel is carrying out renovations whilst a guest is resident. If we are specifically advised of renovation work, dates may be provided. It is important to remember that these are subject to change, and we are not always notified.
CHARGES TO YOUR CREDIT CARD
Any charges made to your credit card whilst away are your responsibility. Signature Travel will not be responsible, nor accept responsibility for having these charges reversed or corrected upon return to South Africa.
DRIVERS LICENCE
Even if you have obtained an international drivers’ licence, please take your national driver’s licence with you.
FORCE MAJEURE
Except where otherwise expressly stated in these conditions, we regret we cannot accept liability or pay any compensation where the performance or prompt performance of our contractual obligations is prevented or affected, or you otherwise suffer any damage or loss, as a result of “force majeure”. In these Conditions, “force majeure” means any event which we or the supplier of the service(s) in question could not, even with all due care, foresee or avoid. Such events may also include war or threat of war, riot, civil strife, terrorist activity or actual threatened terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, epidemics such as SARS, Coronavirus and the like, fire, renovations and all similar events outside our control.
Signature Travel will use it best endeavours to recover from third parties such monies as may have been paid to
them on behalf of the Client. All monies so recovered by Signature Travel will be reimbursed to the Client less a 5% (Five percent) of the Price as an administration charge.
COMPLAINTS
Should you experience any problems with your holiday whilst away, you must immediately inform the supplier of the services in question. If you are still dissatisfied, you must notify Signature Travel immediately to enable us to resolve the problem. Failure to do so may impede Signature Travel’s ability to be able to assist in this regard.
VISUALS
Any visual, whether it be a video, a photograph, or an illustration used are copyrighted and are therefore not to be used or replicated in anyway without prior consent by Signature Travel or the supplier. Visuals reflected on any of the marketing materials or otherwise are a representation only as some images have been enhanced for effect. Please o note that the images are obtained from our 3rd party suppliers and as such may not reflect the service you have booked. Signature Travel accepts no liability for misrepresentation of images.
LAW & JURISDICTION
South African law and the jurisdiction of South African courts will govern the relationship between the Client and Signature Travel. Signature Travel shall be entitled to institute any legal proceedings arising out of or in connection with this contract in any Magistrates Court having jurisdiction in terms of Section 28 of the Magistrates Court Act no. 32/1944 as amended, notwithstanding that the amount in issue may exceed the limits of such jurisdiction
ENTIRE CONTRACT
– The Conditions constitute the entire terms of the relationship between the parties. There exist no other terms, conditions, warranties, representations, guarantees, promises, undertaking or inducements of any nature whatsoever regulating the relationship and the Client acknowledges that he/she has not relied on any matter or thing stated on behalf of Signature Travel or otherwise that is not included herein.
